In accordance with Chapter II of the GDPR and the codes of conduct for the processing of personal data, our company and procedures apply the following principles to the processing of personal data to preserve the rights and freedoms of users:

Minors

In compliance with the provisions of the GDPR, you may contact KIEMMI, as the data controller, at any time in the section Responsible for the processing of personal data of this privacy policy, in order to exercise the rights of access, rectification, erasure, opposition, portability and withdrawal of consent for your personal data included in our files.

A- Right to request access to personal data: you can ask us if we are processing your data, what specific data, where we obtained it from, etc. Article 15 of the GDPR.

B- Right to request their rectification (if they are incorrect) or erasure (when the personal data are no longer necessary in relation to the purposes for which they were collected). Article 16 GDPR.

C- Right to request the limitation or cancellation of your processing, in which case they will only be kept by us for the exercise or defense of claims. Articles 17 and 18.

D- Right to object to processing: We will stop processing your data in the manner you indicate, unless there are legitimate reasons why we have to continue processing it. Article 21.

E- Right to data portability: If you wish your data to be processed by another company, we will facilitate the portability of your data to any other company you indicate, in a structured, intelligible, and automated format. Article 20.

These rights are strictly personal and will be exercised by the data subject, unless they grant sufficient power of attorney to another person. The Data Controller will respond to any request to exercise these rights within ten days of receiving the request. If the Data Controller believes that the request cannot be granted, they will inform the data subject of the reasons for doing so within the aforementioned timeframe.

If you believe there is a problem with how we are handling your data and you are not satisfied with the response to your request, you may file a complaint with the Spanish Data Protection Agency (www.agpd.es). You may also file a complaint with the competent judicial authority if you deem it appropriate.

Data retention period

In accordance with the obligation indicated in article 13.2.a) of the GDPR, we inform you of the retention periods for personal data in each case:

The personal data processed by KIEMMI will be kept until the WEB USER, CLIENT or PARTNER informs us of their wish to cancel the data being processed.

Data secrecy and security

In accordance with the provisions of Article 32 of the GDPR, KIEMMI informs you that it has implemented the necessary technical and organizational security measures to prevent all risks inherent in the activities and services carried out by the company, and to guarantee the security of your personal data and prevent its alteration, loss, and unauthorized processing and/or access, taking into account the state of the art, the nature of the data stored, and the risks to which it is exposed, whether arising from human action or the physical or natural environment. KIEMMI continuously monitors, controls, and evaluates the established processes to ensure respect for the privacy of your data. This data is collected from the user using HTTPS (Hypertext Transfer Protocol Secure), a security protocol that allows for the encrypted transmission of data between the website server and the user, and vice versa.

KIEMMI has conducted a Risk Analysis of the processing of Personal Data, and has the capacity to guarantee the ongoing confidentiality, integrity, availability and resilience of processing systems and services; the ability to restore the availability and access to personal data quickly in the event of a physical or technical incident; and a process of periodic verification, evaluation and assessment of the effectiveness of technical and organizational measures to ensure the security of processing.

In accordance with Articles 33 and 34 of the GDPR, KIEMMI guarantees that in the event of the slightest breach in the systems that may lead to a violation of the security of personal data, the data controller will notify the Spanish Data Protection Agency and the affected parties within a maximum period of 72 hours.
